This Privacy Notice (“Notice”) explains how Dell Technologies, Inc., on behalf of itself and its direct and indirect subsidiaries (“Dell”), the controller, collects, uses and shares your personal data when you register for Live Optics for the purpose of assessing your IT configuration and associated performance characteristics.
We may ask you to provide your personal information when you: (i) register a new Live Optics user account; (ii) request customer or technical support or (iii) use the function in Live Optics that allows users to share configuration analysis data generated using Live Optics with other Live Optics users. You will be asked to provide your name, email address, contact telephone number, and company information.
Dell may use your personal information to: (i) administer Live Optics user accounts; (ii) provide customer or technical support; (iii) provide relevant product notifications; (iv) enhance or customize your user experience and make recommendations; (v) solicit feedback on product quality; (vi) perform Dell’s obligations in the End-User License Agreement for Live Optics (the “EULA”); or (vii) perform other functions or serve other purposes, as disclosed to you at the point of collection, or as required or permitted by law.
Dell will share your personal information within Dell Technologies and its group of companies for the purposes outlined in this Notice. We may also pass on your information to a third party in order to provide Live Optics access and services or solicit feedback on product quality, or for the purposes outlined in this Notice.
Your data will be transferred to and will be stored on Dell servers located in the United States. Dell has taken appropriate steps to protect your data and ensure that any data transfers are in accordance with applicable laws which includes implementing the European Commission's Standard Contractual Clauses for transfers of personal data from Dell to our other group companies outside the EEA. We will take all appropriate technical and organizational measures to safeguard the personal data that we transfer.
Our legal basis for processing your personal data will be on the basis of your consent. If you do not consent or if you later withdraw your consent, then you will not be able to participate in the Live Optics Program.
You may have, among others, the following rights under applicable law to: (i) request access to the personal data that we hold about you; (ii) correct or request, deletion of personal data; and (iii) request Dell to stop processing your personal data (except to the extent required or permitted under applicable statute or other law). We will retain your personal data as necessary in connection with the purposes described in this Notice, and in accordance with Dell’s retention policies and applicable law. Your personal data that is collected by Dell in connection with Live Optics could be kept for up to 10 years after termination of the services.
